MEMORANDUM OF COOPERATION AND INTENT TO ESTABLISH
THE CONFEDERATION OF NON-STATE EXPERTS
AND EXPERT ORGANIZATIONS OF UKRAINE

We, the representatives of public associations of judicial experts and legal entities engaged in judicial activities in Ukraine, as well as experts acting in their personal capacity, recognizing the importance of independence and professional self-governance of the expert community, as well as the need to unite efforts to protect the rights and interests of experts, hereby declare our joint intention to establish the Confederation of Non-State Experts and Expert Organizations of Ukraine (hereinafter — the Confederation).

1. Principles Underpinning the Cooperation

1.Independence — inadmissibility of any unlawful interference by state authorities, political forces, or commercial entities in the activities of experts.

2. Equality — each member organization retains its autonomy and its own statutory structure.

3. Democracy — decision-making based on collegiality, openness, and transparency.

4. Mutual Respect — inadmissibility of discrediting colleagues and their associations.

5. Ethics — adherence to international and national standards of expert activity.

2. Purpose of Establishing the Confederation

Uniting efforts to protect the professional, legal, and social interests of experts.

Promoting the development of independent judicial expertise in Ukraine in line with European standards.

Establishing mechanisms for professional self-regulation and quality control of expert services.

Representing common interests in relations with state authorities, international organizations, and institutions.

Enhancing the professional level of experts through training, exchange of experience, and joint projects/

3. Format and Principles of the Confederation

1. The Confederation is established on a voluntary basis as an alliance (association) of public organizations of experts, legal entities engaged in judicial expertise activities in Ukraine, as well as experts acting in their personal capacity.

2. Each organization retains its own legal personality and independence in internal matters.

3. The governing bodies of the Confederation are formed on the basis of the respective decisions of the General Assembly of its members.

4. Membership in the Confederation does not restrict membership in other national or international professional associations.

4. Joint Obligations of the Parties

1. To promote the establishment and development of the Confederation.

2. To avoid actions that may harm the unity or reputation of the expert community.

3. To mutually inform each other about initiatives that may be of interest or benefit to all participants.

4. To adhere to the principles of this Memorandum in their activities.

5. Final Provisions

1. This Memorandum expresses the joint intentions of the Parties and does not create any financial or legal obligations, except for those expressly stipulated in the future founding agreement of the Confederation.

2. The Memorandum is open for accession by other legal entities and individuals who share its goals and principles.

3. The signing of this Memorandum constitutes the first step towards the preparation of the founding documents of the Confederation.

Signatures of the Parties:

Accession to this Memorandum shall be carried out by affixing an electronic signature, including a qualified electronic signature (including Diia.Signature), using any means that comply with the requirements of the Law of Ukraine 'On Electronic Trust Services'.

The date of accession of a legal entity or an individual to the Memorandum shall be the date of affixing their electronic signature.
